Acceptable Use Policy

This Acceptable Use Policy ("AUP") is set by FAIA LLC ("TrackPlay", "we", "us") and governs everything you upload, host, embed, or distribute using TrackPlay. It forms part of our Terms of Service.

You are responsible for every video in your workspace, including anything uploaded by your team or your clients.

How this actually works

We do not watch your videos. We do not pre-screen uploads, we do not scan them, and we are not obliged to go looking. We host what you upload, at your direction.

So this policy runs on reports. When someone tells us a video breaks the law where it is being shown, we look at that video and we act on it. What we take down is content that is actually unlawful in a jurisdiction that reaches it, or that sits in the list below. We are not the taste police and we do not audit your funnel.

1. You must have the rights to what you upload

Do not upload anything you do not own or do not have a licence to use. This includes:

• Films, TV, music, or recordings you did not create or license.
• Courses, webinars, or training material belonging to someone else, including material you bought but are not licensed to redistribute.
• Footage, music beds, or stock assets used outside the terms of their licence.
• Another person's likeness or voice where you do not have their permission, including synthetic or cloned likenesses.

2. Content that is never allowed

The following is prohibited with no warning and no appeal. Accounts are closed immediately.

• Child sexual abuse material (CSAM), or any sexual content involving a minor, real or synthetic. We report this to the National Center for Missing and Exploited Children (NCMEC) and to law enforcement.
• Non-consensual intimate imagery, including "revenge" content and synthetic intimate imagery of a real person.
• Content that sexually exploits or endangers anyone.

The following is also prohibited:

• Violent extremism or terrorism. Content that promotes, funds, or recruits for it.
• Incitement to violence, credible threats, or content that targets a person or group with harassment.
• Hate content attacking people on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, or sexual orientation.
• Doxxing. Publishing private information about a person without consent.
• Malware, phishing, or credential harvesting, including videos or overlays designed to trick a viewer into handing over passwords or payment details.
• Illegal goods and services. Controlled substances, weapons, counterfeits, stolen data, forged documents, or hacking-for-hire.
• Sexually explicit or pornographic content. TrackPlay is a business tool and does not host adult content.

3. Deepfakes and synthetic people

You may not use TrackPlay to host a video that depicts a real, identifiable person saying or doing something they did not say or do, unless you have that person's permission.

It does not matter how it was made, and it does not matter that the person is famous. A synthesised celebrity endorsing your offer, a cloned voice, a face swapped onto an actor, a fabricated doctor, a fabricated news report, or an invented "as seen on" segment are all prohibited. If the person did not agree to be in your video, they do not go in your video.

You may use synthetic actors and AI-generated presenters who are not real people, and you may deepfake yourself. Get consent, or use someone who does not exist.

4. What you sell is your responsibility

The claims in your video are yours, not ours. We do not review them and we do not approve them. Advertising law applies to you wherever your viewers are, and you are the one who answers for it.

To be explicit, so nobody can say they were not told: do not host content that impersonates a brand, a bank, a regulator, or a public figure; that makes fabricated earnings or health claims; that presents paid actors or invented reviews as real customers; that is structured as a pyramid or Ponzi scheme; or that is designed to show an ad reviewer one video and a viewer another.

We are not going to audit your funnel for this. We will act on a report, and on anything that is plainly unlawful.

5. Rules for how you use the platform

• Do not resell TrackPlay hosting, or use it as a general file store, backup, or CDN for content that is not video you play through our player.
• Do not run automated traffic, bots, or scripts to inflate plays, conversions, or split-test results.
• Do not attempt to bypass play limits, billing, domain locks, or signed URLs.
• Do not probe, scan, or attempt to breach the security of the platform, or access a workspace that is not yours.
• Do not use the platform to send spam or unsolicited bulk messaging.

6. Viewer data and consent

TrackPlay records viewer engagement data and can fire advertising pixels on your behalf. That makes you responsible for the lawful basis and disclosures on your own pages:

• You must have a privacy policy on the page where the player is embedded.
• You must obtain any consent required in your viewer's jurisdiction (for example under GDPR or ePrivacy) before firing advertising pixels.
• Do not use TrackPlay to build audiences from sensitive categories, such as health conditions, sexual orientation, or religious belief, where doing so is unlawful or breaks the ad platform's rules.
• Do not upload data about children under 16 or knowingly target them.

7. How we enforce this

What we do depends on what happened. In most cases we contact you first. For the categories in section 2, we do not.

• Notice. We tell you what breached the policy and give you a window to fix it.
• Content removal or disabling. We may take a specific video offline.
• Suspension. We may suspend playback or the workspace.
• Termination. We may close the account, without refund, for serious or repeated breaches.
• Repeat infringers. We terminate accounts that repeatedly infringe copyright, as described in our copyright policy.

We may also preserve and disclose content and account records where the law requires it, or where it is necessary to protect someone from harm.

8. Reporting a violation

To report content that breaks this policy, email [email protected] with the player URL or the page it is embedded on. For copyright specifically, use the infringement report form.
